Terms & Conditions and Cancellation Policy
Please read this document carefully before submitting your booking form.
1. General Terms of Agreement
1.1. Scope of Work:
The Photographer (Chicago Commercial Photography) agrees to perform photography and/or video services as detailed in the most recent written estimate provided to the Client. Any changes to the scope of work must be agreed upon in writing by both parties.
1.2. Copyright and Usage:
The Photographer retains the copyright to all images and video footage. The Client is granted a non-exclusive, non-transferable perpetual license to use the final delivered assets for the specific purposes outlined in the estimate (e.g., website, marketing materials, social media, print advertising). Commercial resale of the images by the Client is strictly prohibited without a separate written agreement.
1.3. Payment:
A deposit (or retainer) as specified in the estimate is required to secure the date. The remaining balance is due upon delivery of the final digital assets or within the agreed-upon invoicing terms (e.g., Net 30 days).
2. Cancellation and Rescheduling Policy
2.1. Client Cancellation:
Cancellations must be communicated in writing (via email). The following fee structure applies based on the notice period:
- **More than 7 days notice:** Full retainer/deposit is refunded or credited to a future shoot.
- **48 hours to 7 days notice:** The retainer/deposit is non-refundable but may be credited toward a rescheduled shoot if booked within 90 days.
- **Less than 48 hours notice:** The retainer/deposit is non-refundable and will be forfeited.
2.2. Rescheduling:
Rescheduling is subject to the Photographer's availability and may incur a fee if requested with less than 7 days notice, as outlined above.
2.3. Weather & Force Majeure:
If the shoot cannot take place due to severe weather (for exterior shoots) or other acts of nature beyond the control of either party, the shoot will be rescheduled at the earliest mutually convenient date without penalty. Retainers will be held and applied to the rescheduled date.
3. Limitation of Liability
In the unlikely event of total photographic or video failure, cancellation of the contract by the Photographer, or loss of digital files through technical failure, liability shall be limited to a full refund of any monies paid.
